01Who we are

This is the Privacy Policy of Web7 Technologies, LLC ("Web7 Technologies", "Web7", "we", "us" or "our"). It explains how we collect, use, keep and disclose information from our customers, visitors to our websites and, in some cases, visitors to our customers' websites (together, "Users").

Capitalized terms that aren't defined here have the meanings given to them in our Terms of Service.

02Scope and acceptance

This policy covers our website at web7tech.com (the "Site"), our client area at my.web7tech.com, and the Services we provide. It covers both personally identifiable information ("PI") and other, anonymous information ("AI"), together "Information".

You accept this Privacy Policy by using the Site, submitting a form on the Site, or ordering Services from us. Please read it carefully. Information you send through our Services is not automatically considered private, and this policy explains how we treat each type of information.

03Information we collect

Registration and billing information

When you become a customer, you give us information such as your name, address, phone number, email address, username and payment details, plus anything else we need to provide the Services. We also collect information about how you use the Services. Together this makes up your customer record ("Registration and Billing Information").

Payment information

Card payments are processed by Stripe, Inc. Stripe collects and processes your full card details under its own privacy policy. We receive limited details, such as the card type, the last four digits and the expiry date, so we can show them in your account and match payments to invoices.

Inquiries, support requests and website forms

When you contact us, request a demo environment or a migration, submit benchmark results, join a waitlist or open a support ticket, we collect what you give us. That can include your name, email address, website, organization details, current hosting provider, how many sites you have, when your current hosting contract ends, the plan you're on or interested in and what you pay for it, any screenshots you upload, and your message. If you submit benchmark results, we may publish them with the public name you choose, but never your first name or email address. We may ask for more information to verify your identity or resolve your request ("User Inquiry Information").

Technical and usage information

When you visit the Site, we and our infrastructure providers automatically collect technical information. That includes your IP address, browser type, the pages you visit, the referring URL, and the date and time of your visit. We use this to run and secure the Site, understand how it's used, and investigate misuse.

Data on our customers' websites

Our customers store their own websites, email and data on our servers, and that can include information about their own visitors. Each customer is responsible for how they collect and use that information. We only access it as needed to provide and support the Services, keep our network secure, or meet legal requirements.

04How we use information

  • To provide, operate, bill for and support the Services.
  • To send you service notices, invoices, maintenance notices and other messages about your account.
  • To respond to your inquiries and demo requests.
  • To tell you about new products and services. You can ask us to stop these messages at any time.
  • To protect the security and integrity of our network, prevent fraud and enforce our Acceptable Use Policy.
  • To improve the Site and the Services.

We may also use and disclose PI as required or permitted by law. That includes responding to legal process such as a court order, summons or subpoena, cooperating with law enforcement or regulators investigating activity on our Site or network (such as a suspected breach), and establishing or defending legal claims. We use commercially reasonable measures to limit any such disclosure.

05Cookies

We use a small number of cookies that the Site and client area need to work:

  • Client area and session cookies, which keep you signed in to my.web7tech.com and remember your cart.
  • Security cookies set by Cloudflare, which protect the Site and client area from bots and attacks.
  • WordPress cookies, used only when someone signs in to manage the Site.

We don't currently use advertising cookies or third-party analytics. You can block or delete cookies in your browser, but some features, such as signing in or ordering, may not work without them.

06How we share information

We don't sell your personal information. Other than in response to a lawful request by public authorities, we share PI only with third parties acting as our agents, and only for the purposes described in this policy or at the time we collect it.

Service providers

  • Stripe processes card payments.
  • Cloudflare protects and delivers the Site and client area. It processes connection data such as your IP address.
  • Google Fonts and Adobe Fonts deliver the typefaces used on the Site. Your browser connects to their servers, which receive your IP address. Adobe Fonts also counts page views for font licensing.

Our client area and billing system run on WHMCS software that we operate on our own servers.

Our service providers must protect your information with at least the level of protection described in this policy. Where a third-party product is part of the Services we provide to you, its provider may need User Inquiry Information to identify and fix a problem we can't fix ourselves. In that case we require them to keep it confidential. Those providers may have privacy policies that differ from ours, and we'll give you their names and links to their policies on request.

Unsolicited information you send us, such as ideas or suggestions, isn't treated as confidential, even if you mark it that way.

If our practices for processing or using personal information change, we'll tell you, either by updating this policy or by other means, and give you an opportunity to opt out.

07Links to other websites

The Site links to websites and materials provided by third parties, such as social media sites. We don't own or control them, and we aren't responsible for their content, privacy policies or the information they collect.

08Children's information

We don't knowingly collect personally identifiable information from children under the age of 13. If you're a parent or guardian and believe your child under 13 has given us personal information, please contact us and we'll delete it.

09Your choices: access, correction and deletion

  • Access and correction. You can update most of your information yourself in the client area, or ask us for access to your PI and to correct anything that's inaccurate.
  • Deletion. You can ask us to delete your PI, including information about your inquiries, through our contact page.
  • Marketing. You can ask us to stop sending you marketing messages at any time.

For your security, we may ask you to verify your identity before we act on a request.

10How long we keep information

We currently keep the information in your customer record, and information you send us through our forms and support system, until you ask us to delete it.

When you ask us to delete your information, we'll do so unless we need to keep some of it to meet legal, tax or accounting obligations, resolve disputes, prevent fraud or abuse, or enforce our agreements. Deleted information may remain in backups for a limited time until those backups are overwritten.

We may change these retention practices in the future. If we do, we'll update this policy.

11Security

We use technical, physical and administrative safeguards designed to protect PI against loss and against unauthorized access, use and disclosure. Passwords are stored on our servers in encrypted form. Our servers are located in a SOC 2 certified data center in Albuquerque, New Mexico, USA, and backups are stored offsite at a separate location. Unless this policy says otherwise, our employees are required to keep the information described here confidential.

No method of transmitting or storing information is completely secure, so we can't guarantee absolute security.

12HIPAA

The Health Insurance Portability and Accountability Act, known as "HIPAA" for short, does not apply to our products and services. Web7 Technologies is not a "Covered Entity" nor is it a "Business Associate" as we are exempt by the definitions set forth by HIPAA.

The HHS.gov website states: "Situations in Which a Business Associate Contract Is NOT Required." "With a person or organization that acts merely as a conduit for protected health information, for example, the US Postal Service, certain private couriers, and their electronic equivalents."

We provide HIPAA Compliant Web Hosting and the services provided only act as a conduit for protected health information thus a business associate contract is not required.

Only our products and services specifically labeled as "HIPAA Compliant" meet the protocols set forth by the HIPAA compliance standard. Additionally, even HIPAA compliant products and services may be outside of compliance if used improperly. For this reason it is your responsibility as a customer to ensure that the products and services you use are operated in a manner that meets ALL applicable laws and compliance frameworks and not just HIPAA exclusively.

13Testimonials

Under our Terms of Service, you may give us a testimonial or endorsement (an "Endorsement") about the Services, which we may use to promote them. If we publish your Endorsement, you agree that we may use your first name, last initial, home state, voice or likeness, and/or contact information with it. If you'd like us to stop using your Endorsement at any time, contact us and we'll stop soon after processing your request.

14Changes to this policy

If we make significant changes to this policy, we'll notify you by email, post a notice on the Site, or mark the policy as updated on the Site. You agree to receive these communications electronically. If you don't agree with the changes, we'll continue to keep and use PI collected before the change under the policy that was in force when we collected it.
